usl vs bsd the following files come from uunet, between 1992 and 1993 about the case between usl (unix system laboratories) and bsd (berkeley software distribution) ; some files do come from bsdi itself (but its ftp) it was funny that usl attacked bsd to later discover that usl had took code from bsd and ripping away the bsd copyright notices to put that code into their stuff... secret settlement no longer secret the settlement agreement had a provision that did forbid the signatories to publish it. those were : Chris Demetriou (netbsd signatory), Rob Kolstad (bsd/os signatory) and Jordan K. Hubbard (freebsd signatory). but thanks to a groklaw contributor (dburns) a copy has been recently obtained of that settlement, which is signed 2/4/1994 between USL and UCB on that matter. the pdf version is available here below and groklaw has a text rendition [ local copy ] (groklaw.net). USL-UCB 1994 agreement (pdf, 2.1 mb) [ gzipped pdf here (1.6 mb) ] the agreement is pretty clear on the fact that by signing the agreement and putting the mutual lawsuits behind, novell agreed that anyone based on 4.4 lite 2 going forward would be free and clear. the agreement is binding on both parties. there has never been system v code in bsd. the ip which connected bsd with the suit is derived from pre-system v and system iii versions of unix. give credit where it's due while most files here do come from the venerable dennis ritchie, many people do link this page about those (including wikipedia). this page would not exist without him collecting that valuable information (: * [ 00001 ] ( *) annoucement from rob kolstad (bsdi) [ 00010 ] ( *) annoucement from keith bostic (uc kerkeley) * [ 00011 ] ( *) 920420.complaint [ 00100 ] ( *) 920501.documents [ 00101 ] (**) 920501.interrog [ 00110 ] ( *) 920526.dismiss [ 00111 ] ( *) 920610.release [ 01000 ] ( *) 920714.release [ 01001 ] ( *) 920724.complaint [ 01010 ] ( *) 930107.amicus [ 01011 ] ( *) 930108.oppose [ 01100 ] ( *) 930119.mckusick.decl.2 [ 01101 ] ( *) 930119.sup-amicus [ 01110 ] ( *) 930120.oppose.2 [ 01111 ] ( *) 930303.ruling [ 10000 ] (**) 930610.ucb_complaint [ 10001 ] (**) 940206.settled [ 10010 ] (**) 940208.update files marked * come from uunet files marked ** from from bsdi after the ruling, the university of berkeley filed a separate suit under the californian court system. the university's complaint has been supplied by harlan wilkerson docket for the case as supplied by frank sorenson (sco.tuxrocks.com): rulings : o march 3, 1993 o march 30, 1993 o june 29, 1993 o september 7, 1993 university of california's license to at&t for use of bsd materials in sys V.
